We inform the users the Use and Privacy terms and conditions. They apply by the simple use or Access to any of the webpages that integrate the Medimar Corporation Website. In that sense, we understand they accept them and agree to be bound in compliance.
In the case that a user don’t agree with the Use and Privacy terms and conditions, he/she should abstain to use the website.
Medimar Corporation reserves the right to modify the content anytime at its discretion without notice.
The user is understood as the person that Access the website through a computer or mobile device. He/she agrees not to use devices, software or any other media that could interfere with the activities and operations of the website, database or information shown in the website.
1. USE AND RESTRICTIONS
The Access and use of the Website contemplate the complete and unreserved compliance to the Use and Privacy Terms and Conditions. Through the website, the User (any person who access the website) will use the services and content (from now on, "Services and Content"), given to the users by Medimar Corporation’s members, subsidiaries, related parties and affiliates, and Services and Content third parties providers. Medimar will have the right to deny, restrict or conditions the access to the webpages by the user total or partially, to its complete discretion, as well as to modify the Services and Content of the website at any moment without notice.
The user acknowledge that not all the Services and Content of the website are available in every region and that some Services and Content can be used after a contract, activation or registration by the user and/or by a fee, according to contract conditions established in the documents. Medimar doesn’t guarantee the availability and continuous operation of the Website nor the usefulness of the website or the Services and Content regarding any specific activity, regardless of the medium used by the user, including mobile devices. Medimar won’t be responsible for any damage or loss caused by the unavailability or continuous operation of the Website and/or Services and Content.
2. INTELECTUAL PROPERTY
Intellectual property rights regarding the Services and Content, differential signs and domains of the Website, as well as the use rights, including release, publication, production, distribution and transformation, are property exclusively from Medimar.
The User doesn’t acquire any intellectual property right by the simple use of Services and Content of the website and in any moment that use would be considered as an authorization or license to use the Services and Content for purposes other than those referred in the present Use and Privacy Terms and Conditions, and the agreements established.
3. THIRD PARTY INTELLECTUAL PROPERTY
The User agrees to the provisions established in the previous subsection 2 regarding the ownership of Medimar rights also applicable to third party rights, domains or information exposed or related to the website.
4. PERMITTED USES
The User doesn’t have the right to add links to and from the Website, nor the right to put or use the Services and Content of the Website in his/her own website or from third parties, without previous written authorization from Medimar Corporation. Moreover, the User won’t have the right to restrict or avoid another User the use of the Website.
6. SERVICES AND CONTENT QUALITY
Neither Medimar Corporation or its suppliers or partners, would be responsible of any damage suffered by the User as a result of inaccuracies, consultations, typos and changes or updates made periodically to the Services and Content. The recommendations and advices obtained through the Website are general, in that sense they’re not to be taking into account for personal or professional decisions. On this matter it’s imperative to consult the right professional to orientate the User accordingly to his/her specific needs.
7. THIRD PARTY GOODS AND SERVICES
The fact that information from third parties is offered in the website, doesn’t implicate recommendation, warranty, sponsorship or approval by Medimar Corporation, regarding the information, goods and/or services. On respect to Services and Content offered by third parties inside the website or through links to the Website (such as banners or buttons), Medimar Corporation is limited exclusively, for the User convenience: (i) inform the User about the Services and Content, and (ii) be the medium to connect the User with suppliers and sale representatives. The products and/or services commercialize into the Website and/or the sites by third parties are given by independent traders to Medimar Corporation. There isn’t any employment relationship, association or partnership, between Medimar Corporation and those third parties. Every consultation, advice, declaration, information and content linked from the websites linked or inside the Website, represent the opinion and judgment of the third party, moreover, Medimar Corporation won’t be responsible for any damage suffered by the User because of them.
Medimar Corporation is obligated to maintain confidential information received by the User according to the legal provisions applicable in USA. Medimar Corporation doesn’t take any responsibility of maintaining confidential any other information that the User gives, being suscribed in the Website or any other given moment, including the information provided by the User through newsletters, boards, chats; or by information obtained through Cookies by Medimar Corporation and that are described in subsection 10.
9. NOT CONFIDENTIAL OR INDIVIDUAL INFORMATION
Through the use of the Website, the User authorizes Medimar Corporation to use, publish, disclose and communicate publicly not confidential or not individual information, in terms of the Law in Copyrights and the Consumer Protection Law.
The User with access granted to the website, accepts to receive files transmitted by Medimar Corporation’s servers. "Cookie" means a small piece of data sent from a website and stored in a user's web browser while the user is browsing that website. Those files could consist of information such as id given by the User of information to track websites visited by the User. A Cookie can’t read data or information from the hard drive of the User device, nor read Cookies created by other websites.
11. NOTICE OF PRIVACY OF PERSONAL DATA
All the information from the User collected by Medimar Corporation would be treated confidentially according to the provisions of the applicable laws.
At all times, the User is the only and final responsible of maintaining in secret him/her passwords to access certain Services and Content on the Website or in third parties webpages.

Therefore, the User must read the Use and Privacy Terms and Conditions everytime he/she access the Website. Certain Services and Content offered to the users through the Website, are subject to specific conditions that substitute, complete and/or modify the Use and Privacy Terms and Conditions (hereafter, “Particular Conditions”). Accordingly, the User also must read the Particular Conditions before accessing any Service or Content.
In accordance with applicable law, certain services would require the installation of information security tools, the service would be denied if the installation isn’t accepted by the User.
14. APPLICABLE LAW AND JURISDICTION
In order to interpretate, comply and execute the following Use and Privacy Terms and Conditions, the User agrees with the applicable law from USA and the competent courts of the city of Miami, Florida State, expressly waiving any other jurisdiction that may be applicable due to their present or future domiciles or for any other reason.
